THE WILL of FRANCES CROXON of THOLINGTON CHESTER 1900

This is the last Will and Testament of me Frances Croxon of Waterloo Road Tholington near the borough of Crewe in the county of Chester, Widow. I appoint my nephew Matthew Moses Bayley of Alsager in the county of Chester, Draper and my nephew John Bayley of Barthomley near Crewe aforesaid Market Gardener (hereafter called my trustees) to be trustees and executors of this my will. I give and bequeath to each of them my said trustees if they shall act as such trustees and executors as aforesaid the sum of Ten Pounds. I give and bequeath my said nephew Matthew Moses Bayley my oak desk. I give and bequeath to my trustees absolutely all my consumable household stores and provisions and all my wearing apparel and my jewellery. I give and bequeath all my personal estate not hereby otherwise disposed of unto my trustees upon trust that my trustees shall sell all or convert to money the same or each part thereof as shall not consist of money and shall with and out of the monies produced by such sale calling in and conversion and with and out of my ready money pay my funeral and testamentary expenses and debts and the legacies bequeathed by this my will and shall divide the residue of my said personal estate equally between Elizabeth Davenport wife of Henry Davenport, Hannah Adams Wife of John Adams the said Matthew Moses Bayley my nephew William Bayley and the said John Bayley share and share alike. I give and devise all my real estate whatsoever and wheresoever unto my trustees upon trust that my trustees shall enter into the possession and receipt of the rents and profits of the same and shall manage the same with power to let the same for any term of years not exceeding seven years in possession and shall out of the said rents and profits (after deducting expenses of keeping the said real estate or any part thereof in good tenable repair order and condition insured against loss by fire) pay to my brother William Bayley an annuity of Thirteen pounds during his life by equal payments every lunar month or by equal weekly payments if my trustees shall desire, the first payment to be made at the end of five weeks after my death. And shall pay the net residue of the said rents and profits to my said stepson William Croxon during his life Provided always that upon the death of either of them the said William Bayley my brother and the said William Croxon my trustees shall pay the whole of the said rents and profits (after making the deductions aforesaid) to the survivor of them the said William Bayley my brother and William Croxon Upon father trust that my trustees shall sell and convert he said real estate into money and shall (after paying there out all expenses of such sale and conversion) divide the net proceeds thereof into two equal parts or shares And shall divide one of such parts or shares equally between the children of the said William Croxon and the children of my deceased stepdaughter Rebecca Wildblood per capita share and share alike and shall divide the other of each parts or shares equally between my nephews William Bayley Matthew Moses Bayley and John Bayley and my niece the said Hannah Adams and the said Elizabeth Davenport share and share alike Provided always and I hereby declare that if my stepson the said William Croxon shall become bankrupt or make any arrangement with his creditors or shall assign or encumber his interest under this my will or shall do or suffer any act or thing whereby the said interest might become vested in any other person their and in any of such cases the said interest shall pass and go in the same manner as if the said William Croxon had died.
